As per the report of the Ahlmad, the written statement and reply to
the application under Order XXXIX Rules 1 and 2 CPC have been filed on
behalf of defendant no. 1. An application under Order VIII Rule 1 read with
Section 151 CPC seeking condonation of delay in filing the written statement,
along with the list of documents and documents, has also been filed on
22.12.2025.
Learned counsel for the plaintiff submits that copies of the
aforesaid pleadings and documents have not been received.
Learned counsel for defendant no. 1 submits that copies of the
same shall be supplied to the plaintiff within one week from today.
Learned Legal Aid Counsel, Sh. D.K. Malhotra, submits that he is
now representing only defendant no. 2 and seeks discharge from appearing on
behalf of defendant no. 1, as defendant no. 1 has engaged a new Legal Aid
Counsel through the DLSA.
In view of the above, Sh. D.K. Malhotra, learned Legal Aid
Counsel, is hereby discharged from representing defendant no. 1.
Learned counsel for defendant no. 2 seeks an adjournment to file
the written statement along with an application for condonation of delay in
filing the written statement.
