An application under order XXXIII CPC was filed
by the plaintiff. Ld. counsel for plaintiff submits that the plaintiff
wishes to withdraw the aforesaid application as she is willing to
file the Court Fees.
In view of the submission made, the application
under Order XXXIII CPC is disposed off as withdrawn.
Another application u/s. 151 CPC for filing of Court
Fees and for registration of the suit is pending. Court Fees is
hereby taken on record. The present suit be checked and
registered.
Summons of the suit have been accepted by Ld.
counsels for defendant no. 1 & 2, who are present in the Court.
Copies of plaints have been supplied to them from record.
Written Statements alongwith affidavit of
admission /denial be filed by defendant no. 1 & 2 and reply to the
application under Order XXXIX Rule 1 & 2 CPC be also filed
within 30 days from today with advance copy to the opposite
side.

Replication alongwith affidavit of admission/ denial
be filed within 30 days thereafter with advance copy to the
opposite side.
Issue fresh summons for settlement of issues and
notice of application under order XXXIX rules 1 & 2 CPC to the
defendants no. 3, 4 & 5 through all permissible mode, on filing
of PF, returnable for NDOH. Process be given dasti. Steps be
taken within a week.
Written Statements alongwith affidavit of
admission /denial be filed by defendant no. 3,4 & 5 and reply to
the application under Order XXXIX Rule 1 & 2 CPC be also
filed within 30 days from the date of their service with advance
copy to the opposite side.
Renotify the matter for completion of pleadings/
arguments on application under Order XXXIX Rule 1 & 2 CPC
on 29.05.2026.
