alongwith plaintiff.

None for remaining defendants no. 2 to 5.
Ld. Counsel for the defendant no.1 submits that he
had given his appearance on 29.05.2026 on behalf of defendant
no. 2, however, defendant no. 2 is not contacting him. Let court
notice be issued to defendant no. 2 for next date. Ld. Counsel for
the defendant no. 1 shall positively file his Vakalanama on record
within 07 days from today.
Summons sent to defendant no. 3 to 5 received with
the report that the premises was found locked and the summons
were affixed at the main gate on 14.08.2026. Photographs have
also been annexed alongwith the summons. Defendant no. 3 to 5
are deemed to have been duly served on 14.08.2026.
Written Statement on behalf of defendant no. 3 to 5
alongwith affidavit of admission /denial be filed in accordance
with the provisions of law with advance copy to the opposite
side.
Replication alongwith affidavit of admission/ denial be
filed within 30 days thereafter with advance copy to the opposite
side.

No Written Statement has been filed by defendant no.1 till
date. Ld. Counsel for the defendant no. 1 submits that the
husband of defendant no. 1 is in Coma, hence, she is unable to
file the Written Statement. Written Statement be filed by
defendant no.1 in accordance with the provisions of law with
advance copy to the opposite side.
Renotify the matter for completion of pleadings/
arguments on application under Order XXXIX Rule 1 & 2 CPC
on 17.09.2026.
