Order Details: COPY OF ORDER Pdf Text: 13 EX 169/25 Nivedita Magon Vs. Ramashray Yadav 10.10.2025 Present : Ms. Anita, Ld. counsel for the DH. As per the report of the Nazir, the warrants of possession could not be executed as the wife of the Judgment Debtor refused to vacate the suit property. An application under Section 151 CPC has been filed on behalf of the Decree Holder seeking permission for breaking open the lock and for police assistance. In the interest of justice, the application is allowed. The application stands disposed of. Issue fresh warrants of possession in respect of the property in question, authorizing breaking open of the lock, if necessary, with the assistance of the SHO of the concerned police station, upon filing of process fee and a certified copy of the site plan. The DH shall appear before the learned ACJ, East, Karkardooma Courts, Delhi, for appointment of a bailiff on 13.10.2025 at 2:00 p.m. Put up for report on execution of warrants on 31.10.2025. The DH shall also file an affidavit along with process fee stating that no stay has been granted by any superior court in respect of the present execution proceedings.
