Sh. J.K. Sinha, Ld. LAC for the LRs of the defendant no. 1.
Defendant no. 2 in person.
Ld. LAC for the LRs of defendant No. 1 has filed the authority
letters issued by the DLSA on behalf of each of the LRs of defendant No. 1.
Ld. LAC submits that all the LRs are majors and that they have no
objection to the application moved by the plaintiff for impleadment of the LRs.
Since the right to sue survives, and in view of the submissions
made on behalf of the LRs of defendant No. 1, the application under Order
XXII Rule 4 read with Section 151 CPC is hereby allowed, and the LRs, as
mentioned in the application, are taken on record.
Let the amended memo of parties be filed.
The application stands disposed of.
Ld. counsel for the plaintiff is directed to supply a complete set of
pleadings along with all documents to the counsel for the LRs of defendant No.
1.
It is made clear that the LRs of defendant No. 1 shall file their
written statement within 30 days from the date of receipt of the complete set of
pleadings and documents.
Put up for further proceedings on 18.03.2026.
