withdraw the application under Order VII Rule 11 CPC.

no. 1 has been recorded to this effect.
In view of the statement of Ld. Counsel for the
defendant no. 1, the application under Order VII Rule 11 CPC is
dismissed as withdrawn.
At this stage, Ld. Counsel for the plaintiff has
submitted that no written statement has been filed by the defendant
no. 1 till date.
Ld. Counsel for the defendant no. 1 sought some time
to file the written statement.
Defendant no. 1 is directed to file written statement
within 15 days from today subject to cost of Rs. 1000/- (Rs. 500/-
to be paid to the plaintiff and Rs. 250/- each to be deposited in
DSLSA, East and SBA).

Replication, if any, be filed with supply of advance
copy of the same to Ld. Counsel for defendant at least 15 days

hearing.
Be listed for completion of pleadings, admission
denial of documents and for framing of issues on 25.05.2026.
