Defendant no.1 in person.
Replication qua WS of defendant no.2 along-with
rejoinder to reply of application u/O XXXIX Rule 1 & 2 CPC,
affidavit of admission-denial of documents and reply to the
application u/O I Rule 10 CPC filed on behalf of the plaintiff.
The same are taken on record. Copy supplied.
At this stage, Ld. Counsel for plaintiff submits that
copy of application u/O XXXIX Rule 1 & 2 CPC not supplied to
the plaintiff by defendant no.1 till date and even affidavit of
admission-denial of documents not filed on behalf of the
defendants.
In the interest of justice, one more opportunity is
granted to the defendants to file affidavit of admission-denial of
documents within two weeks from today with advance copy to
Ld. Counsel for plaintiff and to supply copy of application u/O
XXXIX Rule 1 & 2 CPC to plaintiff within one week from today
subject to cost of Rs.1,000/- to be deposited in DLSA, East,
KKD. Receipt be filed on or before the next date of hearing.
At request, put up on 23.12.2025 for arguments on
pending applications/ completion of pleadings/ framing of issues/
proposed issues, if any.
