through VC.
Ld. counsel for respondent submits that transfer
petition has already been filed. Ld. counsel for appellant
submits that none has been appearing on behalf of appellant in
the appeal filed by the respondent, which is pending before the
Court of Ld. ASJ-05 and the respondent is adopting delaying
tactics in the present matter and has not been complying with
the order passed by the Ld. Trial Court with regard to interim
maintenance granted to the appellant.
The Court is further apprised that the present
appeal has been filed by the appellant for enhancement of the
interim maintenance granted by the Ld. Trial Court to the
appellant, whereas, second appeal which is pending in the
Court of Ld. ASJ-05 has been filed by the respondent against
the order granting interim maintenance. In the interest of justice,
matter is adjourned. It is made clear that in case no stay order
is placed on record on next date of hearing, the Court shall
proceed to hear the arguments in the matter and finally decide
the appeal. Respondent is also directed to comply with the
order dated 25.05.2024 and furnish the details of the payments
made to the appellant. Appellant is also at liberty to seek
execution of the orders passed by the ld. Trial Court.
