It is submitted that the possession has been taken by
the DH and now there is only issue regarding the mesne profit
which is about Rs. 6/7 lakhs. Part decree is satisfied and for the
purpose of mesne profit the application for stay is allowed and
disposed off on the condition that the JD deposit Rs. 2 lakhs in the
form of FD in the name of this Court.
The main suit is pending for 25.04.2025 and the
application U/o 9 rule 13 CPC has been filed therein. It is
submitted on behalf of the DH that they do not wish to file reply to
the application U/o 9 rule 13 CPC.
Affidavit be filed regarding address of the JD.

It is jointly submitted that the main suit CS 5/2023
titled ‘Vipin Pawar Vs. Tarun’ with the application U/o 9 rule 13
CPC may be preponed for expediting in view of the directions of
Hon’ble Delhi High Court. In view of the same, the suit be also
taken up on the next date. The next date in the main suit i.e
25.04.2025 stands canceled.
