WS on behalf of D1 and D2 has already been filed on 24.08.2024 alongwith
an application under Order VII Rule 11 CPC with documents.
Replication to the WS of D1 and D2 with reply to the application u/o VII Rule
11 CPC with amended memo of parties has already been filed on11.09.2024.
It is submitted by ld. Counsel for defendants that he does not wish to press
upon application u/o VII Rule 11 CPC and wish to withdraw the same.
Heard and allowed.
Accordingly application u/o VII Rule 11 CPC is disposed off being
withdrawn.
Both the parties are directed to file affidavit for admission/denial of
documents within fifteen days from today with advance copy to the opposite side.
It is further submitted by ld. Counsel for plaintiff that his application u/o
XXXIX Rule 1 AND 2 CPC is pending adjudication. In response to this ld. Counsel
for defendant submits that he needs to go through the replication and he has not
received the copy of replication.
In view of the sub missions made by ld. Counsels, plaintiff is directed to
supply the copy of replication to the opposite side and matter is adjourned for
arguments on above application u/o XXXIX Rule 1 and 2 CPC on 26.09.2024 at
12.00 noon.
