Cost of Rs.3000/- is paid by the defendant to ld. Counsel for
plaintiff.
Affidavit of admission & denial of documents is filed on
behalf plaintiff as well as on behalf of defendant. Copy is supplied.
Pleadings are complete. With the available pleadings on
record, the following issues are framed:
1. Whether the plaintiff is entitled for declaration
thereby declaring sale deed dated 12.03.2021 as null and
void? OPP
2. Whether the plaintiff is entitled for partition of suit
property? OPP.
3. Whether the plaintiff is entitled for separate
possession in the suit property as prayed for? OPP
4. Whether the plaintiff is entitled of permanent
injunction as prayed for?
5. Whether the plaintiff is entitled of 1/3rd share of rent
as prayed for? OPP
6. Whether the present suit is barred by law of
limitation? OPD.
7. Whether the plaintiff has not properly valued the
present suit for purpose of court fees? OPD

8. Whether the present suit of the plaintiff is not
maintainable in its present form? OPD
9. Whether the Smt. Kailashwati was absolute owner of
suit property? OPD
10. Whether the suit property is not a single property but
two different properties? OPD
11. Whether the defendants are bona fide purchaser of
the suit property or not? OPD
No other issues arises nor pressed for nor onus of proof objected
to.
Both the sides are directed to file their list of witnesses within
fifteen days from today with advance copy to each other. Plaintiff to file
evidence by way of affidavit of PW with advance copy of the same to the
opposite side.
