It is submitted by both the counsels that an application order 8
rule 1 r/w section 151 CPC filed on behalf of defendants is pending
adjudication.
Arguments heard under order 8 Rule 1 CPC filed on behalf of
defendants.
Having heard the sumbmissions made by Ld. Counsels and the
considering the fact that the matter is pertaining to suit for partition and all the
parties are, as per plaintiff’s version, surviving LRs of deceased Sh. Mahender
Kumar Gupta whose property is being claimed to be partitioned between the
parties. It is observed that the documents sought to be produced are pertaining
to the suit property therefore the same are relevant to the present matter.
However, the defendants have not filed these documents along with their
written statements.
This court is of the opinion that the present application deserves
to be allowed as the documents sought to be produced are relevant in the
present matter. However subject to cost of Rs.3,000/- to be paid to the plaintiff.
Consequently, the documents sought to be produced are taken on
record on payment of Rs.3,000/- as a cost to the plaintiff by the defendant.
Put up for admission denial of documents and framing of issues
on 08.01.2025.
