Fresh miscellaneous appeal received by way of
assignment. It be checked and registered.
Present: Sh. A.K. Tyagi and Sh. Deepak Parashar Ld. Counsel
for appellant alongwith Sh. Mukesh Kumar, one of the
LRs in person.
Sh. Kshitiz, Ld. Counsel for respondent No. 1.
Sh. Vijay Tyagi, Ld. Counsel for respondent No. 2.
Sh. R.P. Srivastava, Ld. Counsel for respondent No. 3
(through VC).
Ld. Counsel for Respondent No. 1 & 2 have filed their
memo of appearance. Same are taken on record.
On the last date of hearing, the Ld. Vacation Judge
issued notice of the present appeal to the respondents.
As per report, Respondent No. 1, Respondent No. 2 &
Respondent No. 3 were served on 24.06.2026.
It is submitted by the Ld. Counsel for the appellant
that Respondent No. 4 was an ex-parte before the Ld. Trial Court
and therefore, there is no possibility to serve Respondent No. 4.
It is submitted by the Ld. Counsel for the respondents
No. 1 to 3 that they have not received the copy of the appeal and
the documents annexed to it.
The soft copy of the same have been supplied to
Respondents No. 1, 2 & 3 through WhatsApp today.
Ld. Counsel for the respondents No. 1 to 3 have
sought opportunity to file reply to the appeal.

Opportunity granted with direction that the same be
filed in Court with supply of advance copy to the opposite side at
least 15 days before the next date of hearing.
As such, be listed for arguments on 24.08.2026. TCR
be summoned at least two days prior to the date fixed.
Date is given as per the choice and convenience of the
Ld. Counsel for the parties.
