Present : Sh. Sultan Chaudhary, Ld. Counsel for the plaintiff.
Ld. Counsel for the plaintiff moved an application under
Order VI Rule 17 CPC seeking amendment in the plaint.
Heard on the application.
Since the suit is at its initial stage and no prejudice shall be
caused to the defendants, if the present application is allowed. In view
thereof, the application under Order VI Rule 17 CPC is allowed.
Amended plaint alongwith amended memo of parties is
taken on record.
It is submitted by the Ld. Counsel for the plaintiff that a
notice may be issued to the SDM, Patparganj, East Delhi for the next date
of hearing because the proceedings under Section 145 Cr.P.C. are pending
for adjudication and is fixed for 07.07.2026.
In view of the submissions of Ld. Counsel for the plaintiff,
let court notice be issued to the SDM, Patparganj, East Delhi with
direction to appear in person or through VC on the next date of hearing.
Issue summons of the present suit upon the all the defendants
on filing of PF within 5 days from today. Copy of the amended plaint be
annexed alongwith the summons.
The plaintiff/any authorised person on behalf of the plaintiff
is allowed to accompany the process server for the service of all the
defendants except defendant no. 6.
Be listed for further proceedings on 13.07.2026.
The date has been given as per the convenience of Ld.
Counsel for the plaintiff.
