Consideration and Findings
The present case involves recovery of a commercial quantity of narcotic
substance (Charas) and attracts the rigor of punishment under Sections 20 and 25 of
NDPS Act, both punishable with a minimum sentence of 10 years. The applicant is
arrayed as one of the co-accused in the present case and he had made full and true
disclosure of facts and seems to assist the prosecution. The Investigating Officer as
well as Learned Addl. PP has no objection to the grant of pardon subject to rules as
the statement u/s 183 BNSS of applicant/accused has already been recorded before
the Ld. MM on 17.05.2025. Hon'ble Supreme Court in
K. Anbazhagan vs. State of
Karnataka, (2015) 6 SCC 86, has observed that the object of tendering pardon is to
facilitate effective investigation and trial by encouraging one of the accused
persons to disclose the true and complete facts to aid in securing conviction of the
principal offenders.
Considering the gravity of the offence, the nature of the investigation, and
the willingness of the accused to cooperate and assist the prosecution by becoming
an approver, this court is of the considered opinion that the prayer for tender of
pardon deserves to be allowed in accordance with Section 343 BNSS and Section
64 NDPS Act and it is ordered accordingly subject to the following conditions:-
(a) that the accused Jordan Andre Furtado shall make full and true disclosure
of whole of the circumstances within his knowledge related to the offence and to
every other person concerned;
(b) that the accused shall appear before this court to depose as a witness
during trial.
The application stands disposed off. Copy of this order be given dasti to the
ld. Counsel for the applicant/accused.
