The matter is listed for the filing of the written statement
by the LRs of deceased defendant along-with an appropriate application
for seeking condonation of delay in filing the same in terms of the order
dated 30.03.2026.
However, no written statement has been filed so far.
Ld. Associate Counsel for the LRs of deceased defendant
sought one more opportunity to comply with the mandate of the order
dated 30.03.2026.
The request has vehemently been opposed by the Ld.
Associate Counsel for the plaintiff on the ground that multiple
opportunities has already been availed by LRs of deceased defendant and
therefore, no further opportunity may be granted to them.
In response to this, Ld. Associate Counsel for LRs of
deceased defendant submitted that due to medical emergency in the
family of the deceased defendant, WS could not be filed and the same
shall be filed within 10 days from today as per the mandate of order dated
30.03.2026.
