The process server has reported that there is no such person at the
given address. The Ld. Counsel for the defendant has filed her
vakalatnama.
Fresh memo of parties and declaration under Order 11
Rule 6 CPC has been filed on behalf of the plaintiff. There is nothing
on record authorizing the plaintiff to file fresh memo of parties. Ld.
Counsel for the plaintiff states that he seeks to correct the address on
record. The same cannot be done in the manner sought.
Ld. Counsel for the defendant has stated that some pages
of the paperbook are illegible. The page numbers are stated to be 18,
23, 33, 64, 86, 120, 134, 171, 173, 185, 195 and 203. It is worth
noting that despite service on 01.08.2026, the defendant chose not to

inform the court about the same and 30 days have already lapsed. At
this stage, a pass over is requested. Be awaited.

admission and denial may be filed in terms of the CC Act according to
the date of service. Advance copy of the WS and affidavit of
admission and denial be supplied to the Ld. Counsel for plaintiff under
acknowledgment and the WS shall be filed with proof of such service.
Replication, if any is sought to be filed by the plaintiff as well as the
affidavit of admission and denial of documents of the defendant, if
filed, be filed thereafter. Advance copy of the replication and affidavit
be supplied to the Ld. Counsel for the defendant under
acknowledgment and the same shall be filed with proof of service.

Put up for completion of pleadings, framing of issues and
case management hearing on 17.10.2026.
Ld. Counsel for the plaintiff states that he has supplied
his own set to the Ld. Counsel for the defendant. He prays that if any
set has been received back unserved, he may be allowed to take back
the same. The Ahlmad shall supply the same, if any has been received
back, to the Ld. Counsel for the plaintiff, under acknowledgment.
