Physical Copy of the vakalatnama filed on behalf of
defendants No. 1 to 3. It be taken on record.
Defendants No. 1 to 3 have filed written statement
alongwith an application under Order VIII Rule 1 CPC seeking
condonation of delay in filing the same, certain documents alongwith
affidavit of admission denial of documents. Copy stated to have been
supplied, which factum has not been controverted by the Ld. Counsel
for the plaintiff.
Heard. Application perused.
For the reasons mentioned in the application under
Order VIII Rule 1 CPC seeking condonation of 65 days in filing the
written statement is hereby allowed, subject to payment of cost of Rs.
1500/- by the defendants to the plaintiff and delay in filing the WS is
hereby condonced accordingly. Joint Written statement filed by the
defendants No. 1 to 3 is taken on record.

At this stage, Ld. Counsel for the plaintiff sought
opportunity to file replication to the written statement filed by the
defendants No. 1 to 3.
Opportunity granted with direction that the same be
filed in Court with supply of advance copy to the opposite side at
least 15 days prior to the next date of hearing.
Perusal of record transpires that on the last date of
hearing plaintiff sought one more opportunity to take appropriate
steps for the substituted service of defendant No. 4.
However, again no steps were taken.
At this stage, Ld. Counsel for the plaintiff again sought
one last opportunity to take appropriate steps for the substituted
service of defendant No. 4.
Opportunity granted.
As such, be listed for report on service of defendant
No. 4, completion of pleadings, filing affidavit of admission denial
of documents by the plaintiff and for framing of issues on
29.10.2026.
Date is given as per the choice and convenience of the
Ld. Counsel for the parties.
