Present: Plaintiff with Ld. Counsels Mr. Rajeev Gupta and Mr.
Archit Gupta.

Mr. Amit Kumar Gautam- Ld. Counsel for the
defendant- 4 to 7.
Defendant- 8 to 10 are exparte (vide order dated
23.12.2025)
Ms. Kanta Chaudhary- Ld. Counsel for the
defendant-11.
Summoned witnesses Mr. Deepak Kumar- JJA, Record Room
(Sessions), East District, KKD Courts, Delhi and Mr. Arvind Kumar-
Junior Engineer- Building Department, Shahdara South Zone,
Patparganj Industrial Area, Delhi examined as PW2 & PW3
respectively and discharged.
Plaintiff submits that he does not wish to examine any other
witness and wishes to close plaintiff’s evidence. Heard.
Statement of plaintiff recorded separately to this effect.
In view of above, plaintiff’s evidence is closed today.
List this matter for defendant’s evidence on 15.09.2026.
At this stage, Ld. Counsel for the defendant-1 to 3 submitted
that defendant-1 to 3 be given liberty to lead evidence after the
examination of witnesses of defendant- 4 to 7 as defendant- 4 to 7
have specifically stated about a family settlement dated 08.09.1985 in
their written statement. The original of said settlement is with the
defendant- 4 to 7.
In view of above, defendant- 4 to 7 are directed to lead
evidence prior to evidence of defendant- 1 to 3.

Defendant-4 to 7 are directed to supply advance copy of
evidence affidavit of the defendant witnesses to the opposite side at
least a week before the next date of hearing.
Further, defendant-1 to 3 are also directed to file their evidence
affidavit by the next date of hearing with its advance copy to the
other side.
