Inspite of opportunity, parties have not filed their affidavits
qua admission and denial of documents.
Pleadings are stated to be complete. From the pleadings of
the parties, following issues are hereby framed:-
ISSUES:-
1. Whether the suit property bearing no. 83, Pal
Mohalla, Chhota Chowk, Mandawali, Fazalpur, Delhi-92
admeasuring 300 sq. yards has already been partitioned
since 1982-83 vide oral partition and thereafter same was
rectified vide family settlement dated 08.09.1985?

2. Whether the plaintiff has not come before the
Court with clean hands and concealed the material facts?

3. Whether the plaintiff is entitled for partition in
respect of suit property bearing no. 83, Pal Mohalla,
Chhota Chowk, Mandawali, Fazalpur, Delhi-92
admeasuring 300 sq. yards as prayed for? OPP
4. Whether the plaintiff is entitled for mandatory
injunction as he prayed in prayer clause - C of the plaint?

No other issue arises or pressed.
List of witnesses be filed by both the parties within 15 days
from today after supplying advance copy to the opposite party.
Let advance copy of evidence by way of affidavit be
supplied to Ld. Counsel for the defendant atleast 15 days prior to the next
date of hearing.
