File is taken up on receiving applications of the plaintiff
for early hearing of the case, under Order 1 Rule 10 of CPC and
under Order 38 Rule 5 of CPC.
Present: Mr. Rahul Rohtagi, Ld. Counsel for the plaintiff.
Record is perused.
Application for early hearing of the case is allowed.
Date already fixed i.e. 31.10.2025 is canceled.
Matter is taken up for consideration.
It is stated that the defendant has created title deeds of the
suit property in favour of Mr. Khalid Kamal and therefore, the
plaintiff wants that Mr. Khalid Kamal be impleaded as defendant
no. 2.
Plaintiff is the dominus litis of his case. Summons are yet
to be served upon the defendant and therefore, the case is at an
initial stage. Application is allowed. Mr. Khalid Kamal is
impleaded as defendant no. 2.
Plaintiff is directed to file amended memo of parties and
amended plaint incorporating the averments qua the newly
impleaded defendant no. 2.
On filing of the same and filing of PF & RC, issue
summons of the suit for settlement of issues and notice of the

pending application for service upon both the defendants by all
modes including WhatsApp.
Copy of the amended plaint, accompanying documents and
pending application be sent alongwith the plaint.
To come up on 31.10.2025.
