Present: Plaintiff with Ld. Counsel Sh. Rahul Rohtagi.
Defendant no.1 & 2 with Ld. Counsel Sh. Mukul Kashyap.
Ld. Counsel for defendant seeks some more time to file
written statement stating that main counsel Mr. Manoj is not well and
therefore, written statement could not be prepared.
Ld. Counsel for plaintiff prayed for ad-interim injunction
stating that during the pendency of the case, defendant no.1 sold the suit
property to defendant no.2 who was impleaded later on in the suit.
Hence, to avoid the multiplicity of conclusion, ad-interim injunction may
be granted.
Heard. Case file perused.
Keeping in view the facts and circumstances of the case and
the submission made, parties are directed to maintain the status quo in
regard to suit property till the next date of hearing.
Let written statement be filed within prescribed period after
supplying advance copy to the Ld. Counsel for the plaintiff who shall be
at liberty to file the replication after supplying advance copy to the Ld.
Counsel for the defendant.
Put up for completion of pleadings and arguments on the
application for interim injunction on 28.01.2026.
