Despite repeated calls of the case, no one has appeared.
No one appeared even on the last date of hearing. It is 2 p.m.
Record is perused.
This is a suit for partition, declaration and permanent
injunction. The valuation of the suit for the relief of possession
mentioned in the plaint is Rs.200/- only. It should have been the value of
the property of which partition is sought.
On 04.07.2025, the Court granted the plaintiffs to correct the
valuation. It was ordered that in case valuation is not corrected, the plaint
shall be rejected.
Till date, no steps have been taken by the plaintiffs for
correcting the valuation. In view of Order 7 Rule 11 (b) of CPC, the
plaint is rejected.
The pending application under Order 39 Rules 1 & 2 r/w
section 151 of CPC is dismissed as the same is now infructuous.
File be consigned to Record Room.
