Present: Sh. Suresh Sharma, advocate for appellant/LRs of
appellant alongwith Sh. Gurpreet Singh, LR.
Respondent no. 1 with Sh. P.R. Sharma, advocate.
No reply is filed by the appellants to the application moved
by respondent no.1 but counsel for appellant stated that he can
directly argue on merits on the appeal itself on the date already
fixed.
The notice to the son/LR of respondent no. 2 has already
been issued through email and whatsapp number provided for the
date fixed as per order dated 10.03.2026. Counsel for respondent
no. 1 stated that respondent no. 2 is not a necessary party as no
relief was claimed against him and the appeal filed against the dead
person is not maintainable. On the other hand, the counsel for
appellant stated that LRs of respondent no. 2 are necessary party as
respondent no.2 expired after completion of the hearings and before
passing of the judgment by the ld. Trial Court.
Put up this matter on 21.04.2026 for final arguments, the
date already fixed. The question whether LR of respondent no. 2 is
necessary party to this appeal or not will be decided also alongwith
request made in this early hearing application for giving directions
to the appellant to pay mesne profit at market rate.
