alongwith defendant in person.
On the last date of hearing, summons of the suit were
issued upon the defendant. As per report, defendant was served on
27.05.2026.
Fresh vakalatnama without the welfare stamp filed on
behalf of the defendant. Be taken on record subject to filing of the
same on the next date of hearing.
Written statement filed on behalf of the defendant. Copy
supplied.
It is submitted by the Ld. Counsel for the plaintiff that he
has instructions from the plaintiff that the plaintiff does not wish to
file replication and affidavit of admission denial of documents.
Separate statement of Ld. Counsel for the plaintiff has
been recorded to this effect.
Separate statement of defendant qua the admission denial
of documents has been recorded.
Pleadings are complete. Accordingly, on basis of the
pleadings of the parties, the following issues are hereby framed for
adjudication of the present suit:-
“1.Whether the plaintiff is entitled to the
recovery of .	₹
6,20,000/- against the defendant ?

2. Whether the plaintiff is entitled to any interest
on the abovesaid amount. If yes, at what rate and

No other issue arises or is pressed for. All the parties are
directed to file list of witnesses within 15 days from today as per the
mandate of Order XVI Rule 1 CPC.
At this stage, respective Ld. Counsel for parties have
submitted that there are chances of an amicable settlement between the
parties and a request has been made to refer the matter to the
Mediation Centre, Karkardooma Courts, Delhi.
In view of the submissions, the matter is referred to the
Mediation Centre, Karkardooma Courts, Delhi for 08.07.2026 at 02:00
PM. Mediation form has been duly filled by the parties. Parties are
directed to appear accordingly.
Put up for report regarding settlement, if any and in
alternative for PE on 24.08.2026.
Advance copy of the evidence affidavit of witnesses to
be examined in PE be filed in Court with supply of advance copy to
the opposite side at least 15 days before the next date of hearing.
The date has been given as per the convenience of Ld.
Counsels for both the parties.
