Present appeal is an appeal under Order 41 Rule 1
r/w Section 96 and 151 of CPC against the impugned order dated
28.03.2026, whereby application under Order VIII Rule 1-A of
CPC moved on behalf of the appellant was dismissed.
Submissions heard. Record perused.
Let notice of present appeal be issued to the
respondent on filing of PF/RC, speed post, approved courier and
through all acceptable modes of service, returnable on NDOH.
Steps be taken within 07 working days.
Ld. counsel for the appellant has requested that
proceedings before Ld. Trial Court may be stayed otherwise the
present appeal will become infructuous.
In view of submissions, proceedings before Trial
court shall remain stayed till NDOH.
TCR be called from concerned court NDOH.
