Ld. Counsel for decree holder has filed an
application under section 151 CPC for issuing transfer certificate
and has submitted that judgment debtor resides in Bengaluru
which is outside the territorial jurisdiction of this Court, he
requests that transfer certificate be issued.
I have considered the submissions and perused the
judicial record. It is observed that as per memo of parties,
judgment debtor resides in Bengaluru therefore, application of
the decree holder seeking transfer of execution petition is
allowed. The transfer certificate be issued to the Court of
Hon’ble District & Session Judge, Rural District, Bengaluru as
prayed by decree holder. The application is disposed off
accordingly.
After due compliance, file be consigned to record
room after due compliance as per rules.
