M/S ZENITH DANCE INSTITUTE PVT LTD 27.05.2025 Fresh appeal under Section 415 Bharatiya Nagarik Suraksha Sanhita (BNSS) received by way of assignment. It be checked and registered as per rules. Present:- Appellant in person along with Ld. Counsels Sh. H. K. Dharlwal and Sh. R. S. Rathi. Ld. Counsel for appellant has pressed for an application seeking stay on impugned judgment dated 25.02.2025 and order on sentence dated 29.04.2025. Submissions heard. Record perused. Vide order on sentence dated 29.04.2025 passed by Ld. Trial Court, appellant/ convict was sentenced to pay Rs.1,15,840/- as compensation. In default thereof, appellant was directed to undergo simple imprisonment for a period of 06 months. Arguments heard on the application under Section 148 of NI Act. Considering the submissions made and totality of circumstances, the appellant is directed to deposit 20% of the compensation amount by way of FDR in the name of Court on or before the next date of hearing in terms of section 148(1) of NI Act. Subject to deposition of aforesaid compensation amount, operation of the sentence dated 29.04.2025 is suspended under Contd….2 -- 1 of 2 -- :2: CA No:- 113/2025 CHARU CHAUHAN Vs. M/S ZENITH DANCE INSTITUTE PVT LTD Section 430 Bharatiya Nagarik Suraksha Sanhita (BNSS) till pendency of the present appeal. Appellant is further admitted to bail on her furnishing a personal bond in the sum of Rs. 10,000/- alongwith one surety in the like amount. In the absence of surety, appellant has furnished personal bond. Same is considered and accepted till the NDOH. Let notice of appeal be issued to respondent on filing PF and RC, returnable for 28.07.2025. Steps be taken within 10 days from today. Trial Court Record be also called in the meantime.
