plaintiff/applicant.
None for respondent/defendant.
None has appeared for respondent/defendant
despite matter being called twice. It is already 02:28 PM. It
does not appear that defendant is interested in filing reply to
application filed by plaintiff. Right of defendant to file reply to
application of plaintiff U/o 9 Rule 9 CPC stands closed.
Arguments on aforesaid application addressed by
counsel for plaintiff/applicant heard.
Counsel for plaintiff has submitted that he could
not take steps for two dates because of some personal
exigency. He has submitted that no prejudice shall be caused to
defendant in case, application in hand is allowed and suit filed
by plaintiff is restored and in case, application in hand is not
allowed, plaintiff will become remediless and will loose his
right to recover his hard earned money from defendant. Heard.
In view of submissions made by counsel for
plaintiff, application filed by plaintiff is allowed subject to cost
of Rs.1500/- to be deposited with DLSA, East by plaintiff
within a week from today.

Suit filed by plaintiff be restored subject to
deposition of cost of Rs.1500/- by plaintiff.
Let record of present application be tagged with
main suit file of CS No.643/24 and let main file be put up for
reporting deposition of cost by plaintiff on 26.12.2025.
