Separate written statements along-with reply to the
application u/O XXXIX Rule 1 & 2 CPC already filed on
04.09.2025 on behalf of the defendant no.1 as well as defendant
nos.3 to 5. The same are taken on record. Copy supplied.
Affidavit of admission-denial of documents also
already filed on 04.09.2025 on behalf of the contesting
defendants. The same is taken on record. Copy supplied.
Replication qua WS of aforesaid defendants already
filed on behalf of the plaintiff on 06.10.2025. The same is taken
on record. Copy supplied.
Ld. counsel for plaintiff submits that plaintiff does
not wish to file affidavit of admission-denial of documents.
Pleadings stated to be completed. From the
pleadings of the parties, following issues are hereby framed:-
a) Whether the plaintiff is entitled for a decree of
partition in respect of her 1/6th share in the suit
property i.e. A-102-B, South Ganesh Nagar,

Delhi-110092, admeasuring 77 sq. yds. Out of
Khasra no.154/928/512, as prayed for? OPP
b) Whether the plaintiff is entitled for a decree of
permanent injunction thereby restraining all the
defendants from creating third party interest in the
suit property, as prayed for? OPP
c) Whether the plaintiff has not valued the
present suit properly for the purpose of Court Fee?

No other issue arises or pressed for.
Put up for PE on 17.03.2026. List of witnesses be
filed within stipulated period by both the parties. Let affidavits of
evidence of all the plaintiff’s witnesses be filed within four
weeks from today with advance copy to Ld. counsel for the
