Present: Sh. Virender Singh, Ld. Counsel for the plaintiff/non-
applicant alongwith plaintiff/non-applicant in person.
Sh. Honey Kaushik, Ld. Counsel for the applicants/
defendant no. 2 in person.
Perusal of record transpires that on the last date of
hearing, plaintiffs/non-applicants sought opportunity to file reply to
the applications (i) under Section 5 of the Limitation Act (bearing IA
No. 2/2026), thereby seeking condonation of delay in filing the list
of witneses and (ii) application (bearing IA No. 1/2026) under
Section 151 CPC to construct the boundary wall and gate at the
entrance and toilet and bathroom at the backside of the property of
the defendants.
Ld. Counsel for the plaintiff has filed the reply to the
application under Section 151 CPC. Copy supplied.
Heard on the application under Section 5 of the
Limitation Act (bearing IA No. 2/2026), thereby seeking condonation
of delay in filing the list of witneses. For the reasons mentioned in
the application and the fact that the plaintiff evidence is yet to be
startet, present application (bearing IA No. 2/2026) is allowed and
list of witnesses filed by the defendant is taken on record.
PW-1 Sh. Ram Pal examined, cross-examined and
discharged.

Ld. Counsel for the plaintiff sought an opportunity to
file the evidence affidavit of remaining witnesses.
Opportunity granted with a direction that the same be
filed in court and supplied to the other side atleast 15 days prior to
the NDOH.
Perusal of record transpires that vide order dated
10.09.2026, cost of Rs. 3000/- was imposed upon defendant.
However, on oral request of the Ld. Counsel for the defendant cost
of Rs. 2000/- is waived and remaining cost of Rs. 1000/- has been
paid by the defendants to the Ld. Counsel for the plaintiff today.
As such, be listed for PE as well as for arguments on
the pending application on 10.12.2026.
Date is given as per the choice and convenience of the
Ld. Counsel for the parties.
