person.
Ms. Karuna Gahlaut, Ld. Counsel for the defendant no.1.
None for defendant no. 2.
Fresh vakalatnama without the welfare stamp filed on
behalf of the defendant no. 1. Be taken on record subject to filing of
the same on the next date of hearing.
It is submitted by the Ld. Counsel for the defendant no. 1
that the defendant no. 1 had suffered with the paralysis recently and
therefore, the written statement could not be filed in accordance with
the provision of Order VIII Rule 1 CPC.
Accordingly, it is submitted by the Ld. Counsel for the
defendant no. 1 that the same shall be filed on or before the next date
of hearing alongwith an appropriate application for seeking
condonation of delay in filing the same.
Granted with the direction that the same be filed in Court
with supply of advance copy to the opposite side at least 15 days
before the next date of hearing.
Both the parties are directed to maintain status quo
regarding the suit property till the next date of hearing.
Be listed for further proceedings on 02.09.2026.
The date has been given as per the convenience and
request of Ld. Counsel for the parties.
