Present: Sh. Sumit Goswami, Ld. counsel for the DH (through
VC).
An application for restoration of execution application
has been moved. Same has been registered. Be checked as per rules.
Since the JD was not appearing, notice to the restoration application is
not required to be served upon the JD.
Submissions heard. Ld. Counsel for the DH submits that
on 22.04.2025, when the execution application was dismissed in
default and for non prosecution, he could not appear as his son was
not well and he had to rush to the hospital. Documents to that effect
have been annexed with the application. Application stands allowed.
Execution application is restored to its original number.
Ld. Counsel for the DH is directed to furnish address of
the JD by way of an affidavit. Matter be listed for said purpose on
30.07.2025.
