Present : Sh. Manish Chhokar, Ld. Counsel for the plaintiff along with
plaintiff.
Mohd. Danish, Ld. Counsel for the defendant along with
defendant.
Learned Counsel for the plaintiff submits that the cost of Rs. 1,000/– has
been received from the defendant.
Vide separate statements of the plaintiff and the defendant, the process
of admission and denial of documents has been duly recorded. Both parties have
further stated that they are not inclined to refer the matter to mediation or any other
mode of alternative dispute resolution.
Since the pleadings are complete, and upon consideration thereof, the
following issues are hereby framed for adjudication:
1. Whether the plaintiff is entitled to a decree of Rs. 10,00,000/–
(Ten Lakhs Only) as prayed for? OPP
2. Whether the plaintiff is entitled to interest, and if so, at what rate
and for what period, as prayed for? OPP
3. Whether the suit is barred by limitation? OPD
4. Relief.
No other issue has been pressed, raised, or disputed with respect to the
burden of proof.
Put up for plaintiff’s evidence on 05.12.2025.
Parties are directed to file their respective lists of witnesses within 15
days from today and supply an advance copy to the opposite party. They shall also file
their evidence by way of affidavits, with an advance copy served upon the opposite
party, at least 15 days prior to the next date of hearing.
