Order Details: COPY OF ORDER Pdf Text: CA No:- 53/2025 LAXMI RAWAT Vs. DAULAT SINGH BISHT 18.03.2025 Fresh appeal under Section 415 Bharatiya Nagarik Suraksha Sanhita (BNSS) received by way of assignment. It be checked and registered as per rules. Present:- Appellant in person along with Ld. Counsel Mr. Mohd. Ikram. Ld. Counsel for appellant has pressed for an application seeking stay on impugned judgment dated 15.01.2025 and order on sentence dated 12.02.2025. Submissions heard. Record perused. Vide order on sentence dated 12.02.2025 passed by Ld. Trial Court, appellant/ convict was directed to pay compensation of Rs. 6,00,000/- along with simple interest @ 9% p.a. from the date of filing of the present complaint within a period of 30 days to the complainant and in default thereof, to undergo simple imprisonment for a period of 3 months. As regards deposition of compensation amount under Section 148(1) of NI Act, it is prayed on behalf of appellant that compensation amount may not be ordered to be deposited as appellant had already deposited a sum of Rs. 5,35,500/- before Hon’ble Delhi High Court in respect of a civil suit qua same transaction between the parties. Keeping in view the totality of circumstances and submissions made, appellant is directed to deposit 10% of the compensation amount by way of FDR in the name of Court on or Contd….2 -- 1 of 2 -- :2: CA No:- 53/2025 LAXMI RAWAT Vs. DAULAT SINGH BISHT before the next date of hearing in terms of section 148(1) of NI Act. Subject to deposition of aforesaid compensation amount, operation of the sentence dated 12.02.2025 is suspended under Section 430 Bharatiya Nagarik Suraksha Sanhita (BNSS) till pendency of the present appeal. Appellant is further admitted to bail on his furnishing a personal bond in the sum of Rs.15,000/- alongwith one surety in the like amount. In the absence of surety, appellant has furnished personal bond. Same is considered and accepted till the NDOH. Let notice of appeal be issued to respondent on filing PF and RC, returnable for 26.05.2025. Trial Court Record be also called in the meantime. Steps be taken within 10 days from today.
