Accused/appellant has submitted a cheque bearing
No.204434 of Rs. 4,50,000/- drawn on Indian Bank, Jagatapuri
Branch, Delhi in favour of the Respondent in compliance of
order dated 14.03.2024. Although, on the last date of hearing,
appellant was directed to submit demand draft but appellant has
submitted a cheque that is a post dated cheque of 15.6.2024. Ld.
Counsel for appellant/accused further submits that they have

already discussed the same with the respondent and he has no
objection in accepting the post dated cheque dated 15.06.2024. In
view of the same, the Appellant is allowed to hand over the said
cheque to the Respondent. The same is given to the Respondent
in Court today.
However, it is made clear that if the said cheque will be
bounced then order for suspension of sentence dated 14.03.2024
shall automatically vacated and accused has to immediately
surrender before the Ld. MM.
Ld. Counsel for appellant/accused requests for an
adjournment on the ground that main counsel is not available to
address further arguments on the instant appeal.
Heard. Matter is adjourned.
