This is an appeal against judgment and order on
sentence dated 23.12.2023 and 31.01.2024 respectively passed by
Ld. MM (NI Act), East District, Karkardooma Courts, Delhi, in
complaint case no. 58005/2016, titled as “Manoj Kumar Vs.
Multan Khan”, U/s 138 NI Act, wherein appellant has been
convicted for the offence U/s 138 NI Act and has been sentenced
to pay a compensation of Rs. 14 lacs along with interest at the
rate of 9% p.a. to respondent w.e.f. 18.05.2016.
Heard.
Appeal is admitted subject to just exceptions.
Ld. counsel for appellant pressed application U/s 389
CrPC for suspension of sentence and for grant of bail to the
appellant/convict.
Heard.
It is mentioned that the sentence of the appellant has
been suspended by the Trial Court till filing of appeal.
Considering the facts and circumstances of the case and that
decision of the appeal is likely to take some time, the execution
of sentence is suspended during pendency of appeal subject to
furnishing of a bank draft in sum of Rs. 4.5 lacs in name of
complainant on or before next date of hearing.

Appellant is admitted to bail on his furnishing personal
bond in the sum of Rs. 20,000/- with one surety of like amount.
Bond furnished and accepted.
Respondent has accepted the notice of appeal. Copy of
appeal along with documents be supplied to respondent no. 2.
Vakalatnama has been filed on behalf of respondent no. 2.
TCR be summoned.
Copy of this order be sent to the Trial Court for
information.
Matter be listed for report regarding compliance
of order and for arguments on 07.05.2024.
