Present: Mr. Ravi Mohla, Ld. Counsel for plaintiff.
Mr. Simon Samson, Ld. Counsel for defendant.
Interim report filed on behalf of Ld. LC. Be taken on record. As
per report of Ld. LC, no witness has been examined and Ld. Counsel for
plaintiff has submitted that initially, Ld. LC was not available and thereafter AR
of the plaintiff had difficulty, due to no witness could be examined. It is further
submitted that even on one day, Ld. Counsel for defendant had some difficulty.
Though conduct of the plaintiff is not upto mark as not even a
single witness has been examined till date, yet case is adjourned for recording
of evidence of both parties by Ld. LC, subject to cost of Rs. 5,000/- to be paid
with DLSA.
Plaintiff is directed to conclude PE within 15 days positively and
evidence of defendant also be recorded within 15 days thereafter. Advance copy
of affidavit of witness has already been supplied to Ld. Counsel for defendant.
Advance copy of affidavit of DW by defendant also be supplied
atleast 7 days prior to recording of DE. In case, both parties fail to conclude
PE/DE within specified period, then each party shall be liable to pay cost of Rs.
50,000/-.
Put up for final arguments on 22.10.2026.
Intimation be sent to Ld. LC about the order of this court for
compliance. Meanwhile, both parties shall be at liberty to file their written
submissions thereby exchanging copies to each other.
