no.2 along-with the respondent no.2.
Vakalatnama filed on behalf of the respondent
no.2. The same is taken on record. Ld. Counsel for respondent
no.2 undertakes to file the same online during the course of the
day.
Ld. Counsel for respondent no.2 seeks some time
to file the objections.
Perusal of record shows that on the last date of
hearing also, adjournment was sought by respondent no.2 to
file the objections.
However, in the interest of justice, one more
opportunity is granted to the respondent no.2 to file the
objections subject to cost of Rs.3,000/- to be deposited in
DLSA, East, KKD within one week from today. Let the
objections be filed within two weeks from today with advance
copy to Ld. Counsel for the petitioner.
Thereafter, replication/ rejoinder, if any be filed on
or before the next date of hearing.
Both the parties are also directed to file their

respective affidavits of admission-denial of documents on or
before next date of hearing with advance copy to the opposite
party.
Perusal of record shows that original Will as well
as surviving member certificate has not been filed on record.
In view thereof, petitioner is directed to file the
original Will dated 08.11.2016 and surviving member
certificate on or before the next date of hearing.
Put up on 22.03.2025 for arguments on objections/
completion of pleadings/ framing of issues/ affidavits of
admission-denial of documents.
