Present: Sh. Kalash, Ld. Proxy counsel for the plaintiff (through
VC).
Present is a suit for permanent injunction, restraining of
trademark and copyright, passing of unfair competition, delivery up,
dilution and rendition of accounts/damages. The suit is accompanied with
an application under section 12-A of CC Act, an application under order
39 Rule 1 and 2 of CPC, an application under Order 26 Rule 9 of CPC, an
application under Order 11 Rule 1(4) of CPC, an application under Order
39 Rule 3 of CPC and an application under Section 151 of CPC.
The plaint is not signed on every page. Statement of truth has
been filed. It is, however, not as per the format. Declaration under Order
11 Rule 6 of CPC has also been filed. Ld. counsel for the plaintiff states
that he wishes to withdraw the application under Order 39 Rules 1 and 2
CPC. However, his statement cannot be recorded through VC. In any case,
the objections have to be removed. Matter be listed for said purpose on
27.02.2026.
