Present: Sh. D.K.Yadav, Ld. Proxy Counsel for the plaintiff.
Statement of truth has been filed in between. It is noticed
that Ahlmad is not tagging the files everyday. He is directed to do so
forthwith in all cases.
Further submissions have been heard. As per the case of
the plaintiff, the defendant had applied for a trademark in 2022 which
came to the notice of the plaintiff. The plaintiff issued a seize and
desist notice to the defendant in 2024. The defendant telephonically
assured the plaintiff that she would stop using the impugned
trademark after the ready products had been sold. It is the case of the
plaintiff that defendant has not adhered to the same.
The plaintiff has known about the usage of the impugned
trademark since 2022 and has been waiting for the defendant to adhere
to her assurance for past two years. While the plaintiff may be entitled
to an injunction, the timeline shows that the plaintiff is not entitled to
by-pass pre-litigation mediation. Ld. Proxy Counsel for the plaintiff

seeks time to take instructions. Matter be listed for further proceedings
on 19.03.2026.
