Present: Shri Deokant Tripathi – Ld. Counsel for plaintiff.
Mr. Shoaib Khan – Ld. Counsel for defendant joined
through VC.
Amended statement of truth has already been filed by the
defendant, copy of which has been supplied through whatsapp.
Plaintiff has filed replication to the WS as well as one
application for change of AR. Copies supplied.
As per the plaintiff, previous AR of the plaintiff has been
transferred and in his place Mr. Harun Rashid has joined as Senior
Manager in whose favour authority letter has already been issued.
Considering the facts and circumstances, application filed for
change of AR is allowed. Mr. Harun Rashid is substituted as new AR.
Pleadings have been completed.
From the pleadings of the parties, following issues are framed
for adjudication:-
ISSUES:-
1. Whether the plaintiff is entitled for a decree of
recovery of Rs.11,62,719.83/- from the
defendant? OPP
2. Whether the plaintiff is entitled for
pendentelite and future interest? If so, at what
rate and for which period? OPP
3. Relief
No other issue arises or is pressed for.
List of witnesses be filed by both the parties within 15 days
from today. Both the parties are directed to file their respective

affidavits of examination in chief by the next date after exchanging
copies of the same.
Case management hearing conducted. The schedule of trial is
as under:-
Renotify for plaintiff’s evidence on 03.12.2024, for DE on
19.12.2024 and for final arguments on 07.01.2025.
Put up for PE on 03.12.2024.
