Matter is fixed for clarification / order on
application under Order VII Rule 11 CPC.
Ld. counsel for the plaintiff requests that an
opportunity may be given to the plaintiff to address arguments on
application under Order VII Rule 11 CPC.
Ld. counsel for the plaintiff submits that suit
property bearing house no. B-1/30, Harijan Basti, Rajveer
Colony, Gharoli Extension, Delhi-110096 was allotted by DDA
to Sh. Rameshwar Prasad / father of plaintiff and another suit
property bearing house no. 11/157, Trilok Puri, Delhi-110091
was allotted by DDA to grandfather Sh. Sher Singh of the
plaintiff by DDA under Jhuggi Jhopri Removal Scheme.
In view of submissions of Ld. for the plaintiff, let
notice under Section 30 of CPC be issued to Chief Executive
Officer, Delhi Urban Shelter Improvement Board, Govt. of NCT
of Delhi to file status report qua properties i.e. house no. B-1/30,
Harijan Basti, Rajveer Colony, Gharoli Extension, Delhi-110096
and 11/157, Trilok Puri, Delhi-110091 on NDOH.

Ld. counsel for the plaintiff further submits that
defendant no. 1 has created third party interest in the property
bearing no. 11/157, Trilok Puri, Delhi-110091.
Ld. counsel for the plaintiff seeks time to move an
appropriate application to amend the plaint to pray for partition
of the property bearing no. B-1/30, Harijan Basti, Rajveer
Colony, Gharoli Extension, Delhi-110096 as well. Let the same
be filed with advance copy to opposite party.
In view of the aforesaid facts and circumstances of
the present case, put up for consideration on application under
Order VII Rule 11 CPC; filing of application on behalf of the
plaintiff, reply / arguments and disposal of said application as
well as filing of status report on behalf of the DUSIB, on
17.02.2026.
Interim order dated 29.01.2025 to continue till
NDOH.
