Fresh suit has been received by way of assignment. It be checked
and registered as per rules.
Present : Sh. Dileep Kumar Suryawanshi, Ld. Counsel for the
plaintiff.
This is a suit for partition and permanent injunction
filed on behalf of the plaintiff.
Ld. Counsel for the plaintiff presses for application
under Order 39 Rule 1 and 2 of CPC praying for grant of ex-parte
ad interim injunction in favour of plaintiff and against the
defendants. It is submitted on behalf of plaintiff that defendant
no.1 is in the process of creating third pary interest in the suit
property bearing no. 11/157, third floor, Trilokpuri,
Delhi-110091.
Submissions heard. Record perused.
The court is of the opinion that the suit property
bearing no.11/157, Trilokpuri, Delhi-110091 needs to be
preserved till NDOH.
Therefore, parties to the suit are directed to maintain
the status quo regarding title and possession of the suit property
till NDOH.

Plaintiff is directed to comply the requirement of
order XXXIX Rule 3 of CPC.
Summons for the settlement of issues and notice of
the application under Order XXXIX Rule 1 and 2 CPC and also
to the application under Section 80 r/w Section 151 CPC be
issued to the defendants on filing of PF/RC/copies and speed post
as well as approved courier for 14.02.2025.
Copy of this order be given dasti to plaintiff.
