Ld. Counsel for plaintiff has filed one application under Order
11 Rule 1 (5) of CPC for placing on record additional document i.e.
certificate under Section 63 of BSA, 2023 and has prayed that application
may be allowed.
Heard.
Since plaintiff is willing to file additional document i.e.
certificate under Section 63 of BSA, 2023 and same may be helpful for the
proper adjudication of this case, accordingly application is allowed and
additional document i.e. certificate under Section 63 of BSA, 2023 be taken
on record.
PW1 Sh. Devendra Yadav and PW2 Sh. Gurmeet Kumar
Mishra are present and have filed their affidavits in evidence, but nil
opportunity given for cross examination of PWs as main counsel for
defendant is not available and stated to be busy before Hon’ble High Court.
PW1 and PW2 examined and discharged.
Put up for remaining PE on 29.09.2026. Advance copy of
affidavit be supplied to opposite party atleast 7 days prior to next date of
hearing.
