Record is perused.
Application of the plaintiff u/s 151 of CPC for exemption from
filing fair and typed copies of annexures is allowed.
Ld. Counsel for plaintiff submits that the plaintiff is not
opposing the application of defendant no.2 u/o 8 Rule 1 of CPC.
In view of the no objection given, the said application of
defendant no.2 is allowed. Delay in filing of written statement by defendant
no.2 is condoned. The written statement is taken on record.
At joint request of the Ld. Counsels, defendant no.2 who is
mother of defendants no.4 & 5 (minors) is appointed as their guardian.
Let replication be filed within 30 days from today after
supplying advance copy to Ld. Counsel for defendants no.2, 4 & 5.
Let affidavits for admission and denial of documents be filed
by the next date of hearing after supplying advance copy to the opposite
counsel.
To come up for framing of issues on 04.09.2025.
