None for defendant-1

Defendant-3 is exparte
(vide order dated 03.05.2025).
Mr. D.K. Sharma & Ms. Seema, Ld. Counsels for the
defendant-2, 4 and 5.
In spite of calls and waiting, none appeared for the
defendant-1.
Record reveals that none has been appearing for defendant-1
since 29.05.2025. Hence, the defendant-1 is hereby proceeded against
ex-parte.
Ld. Counsel for the plaintiff submitted that defendant has not
filed any document relating to parties to the suit, so the plaintiff has
not filed any affidavit qua admission denial of documents.
It is noted that defendant-2 filed her affidavit qua admission
denial of documents on 26.02.2026. Copy supplied.
Pleadings have been completed.
From the pleadings of the parties the following issues are
framed:-
(1) Whether the plaintiff is entitled for a decree of possession
against the defendants in respect of suit property i.e. Three
Room Set of Flat No. 2 on the first floor in the property
bearing no. D-63, Gali No. 2, Laxmi Nagar, Village Shakar
Pur Khas Illaqua, Shahdara, Delhi-110092?OPP
(2) Whether the plaintiff is entitled for recovery of arrears of
rent @ 12,000/- per month for 13 months i.e. Rs. 1,56,000/-
and further, entitled for rent from the date of filing of the
suit till handing over the possession of the suit property?

(3) Whether the plaintiff is entitled for interest, if so, at what
rate and for what period?OPP
(4) Whether the plaintiff is entitled for permanent injunction, as
prayed for?OPP
(5) Relief.
No other issue arises or pressed for.
Now to come up for plaintiff’s evidence on 22.04.2026.
List of witnesses be filed by the parties, with its advance copy
to the other side.
Plaintiff is directed to supply advance copy of evidence
affidavit of the plaintiff witnesses to the defendant/ Ld. Counsel for
the defendant at least a week before the next date of hearing.
