Present: Mr. Anuj Tyagi, Ld. Counsel for plaintiff.
Ld. Counsel for plaintiff has submitted that this court has
no territorial jurisdiction to entertain this suit and suit has to be filed
before Ghaziabad Court. It is further submitted that on the instruction
of the plaintiff, this suit may be returned to the plaintiff to present the
same before the court of appropriate jurisdiction.
Statement of counsel for plaintiff to this effect recorded
separately.
In view of statement of counsel for plaintiff, this court has
no territorial jurisdiction to entertain this case and suit has to be filed
before Ghaziabad Court. Accordingly, this plaint is returned to the
plaintiff to present the same before the court of appropriate
jurisdiction.
File be consigned to Record Room after returning the
plaint to the plaintiff after keeping on record a copy of the plaint and
documents.
