Counsel for the plaintiff submitted that though the present suit has been filed under Order XXXVII CPC, but plaintiff instructed her to make a submission/statement that it be treated as an ordinary suit for recovery, against the defendants. Heard. Statement of Ld. Counsel recorded separately to this effect. In view of above submission of the Ld. Counsel for the plaintiff, the present suit is treated as an ordinary suit for recovery against the defendants. Heard. Case file perused. Issue summons of the suit for settlement of issues for service upon the defendants through all permissible modes on filing of PF and RC within two weeks.
