It is observed that service to defendant no. 1 has
been effected through email on 27.02.2024, but service through
other modes has not been effected to defendant no. 1.
Ld. Counsel for the plaintiff has submitted that
defendant no. 1 has not filed appearance within stipulated period
of ten days from the date of service, therefore suit of the plaintiff
may be decreed u/O XXXVII Rule 3 of CPC.
I have considered the submissions.
Ahlmad is directed to report if defendant no. 1 has
filed appearance in accordance with Order XXXVII of CPC or
not.
